I see MAGAs on here gloating about the ABC defamation lawsuit. Let me explain what Trump did to E Jean Carroll and then you can decide whether he raped her or not.
Carroll testified that she struggled to get Trump off her as he shoved his mouth on hers, yanked her tights down, and penetrated her with his hand and then his penis. She described him curving his finger inside her, saying it was "extremely painful" and "a horrible feeling."
Under New York criminal law, an assault constitutes "rape" only if it involves vaginal penetration by a penis. That was the definition the jury was instructed to use in the civil case. Why was it a civil case and not criminal? It's because the statute of limitations had expired based on how long ago the crime had occurred.
The jury's conclusion was that Trump did in fact commit sexual assault by sticking his fingers in her vagina against her consent, but there wasn't sufficient evidence that he penetrated her with his penis, which is the narrow definition of rape according to NY law.
Federal Judge Lewis Kaplan ruled in August that the jury verdict showed Carroll's rape allegation was "substantially true" The judge is correct. Trump is as adjudicated rapist.
