First offense: 1 year minimum up to a maximum of 3 years -or- 1 year and a $2500 fine

Second offense: Used to be a felony and mandatory 5 years. They got rid of the 5 year mandatory part.

Soft on crime? Yep.


We could get onto a tangent about how effective prison is. But, instead, I'll just say I don't agree with maximum sentences, either. It should be up to the judge. You can't really legislate every contingency. That's why we have a judge to judge. I get that the intent is to reduce inconsistencies from one judge to another (e.g. a "hangin' judge" vs a "regular" judge). But I don't think those sorts of laws yield a greater benefit than just relying on the judges.
