Yes, it would be all over the news. The article you linked is merely citing the legal opinions of several lawyers:

As legal experts Norman L. Eisen, Joyce Vance, and Richard Painter note, "A conflict of interest requires more than a theoretical or speculative conflict."

That is, the ruling should be obvious at this point, but it hasn't been finally made in court yet.
