Under the change, VA examiners must rate disabilities based on how a veteran functions while taking prescribed medication, rather than estimating how severe the condition would be without treatment.

The VA stated in the notice: “If medication or other treatment lessens the functional impairment a disability causes and thereby improves a veteran’s earning capacity, that is the proper disability level for which the veteran should be compensated.”

VA officials argue the change merely clarifies long‑standing practice and avoids what they describe as speculative assessments of an unmedicated baseline.

But House Committee on Veterans Affairs ranking member Mark Takano has described it as a “harmful decision.”

“This rule change penalizes veterans for taking medications to address their conditions and symptoms, putting veterans in a place of deciding between managing their health and receiving their full benefits,” he said.
