We cannot give everyone a trial, because to do so would take, without exaggeration, 200 years. We would need hundreds of thousands of trials for the hundreds of thousands of Illegals we are sending out of the Country. Such a thing is not possible to do.

Ah, but there's the rub. How do you know that they are illegal and subject to deportation unless you have a process for determining that they're illegal and subject to deportation?

No one's stopping the Administration from "remov[ing] criminals from our Country." They're just going to make the government prove that the people they seek to remove are, in fact, criminals. As has always been the case.

Now, he is correct that he can't possibly deport as many people as he wants without giving everyone the hearing they're entitled to. The system doesn't have the capacity to move a million people through the pipeline in a year. They don't have the judges or lawyers to do it. That's why they're looking for a workaround - any workaround - that can get that throughput up.

Of course, it's not like John Thune didn't warn them about this. The reason he was advocating a second reconciliation package on energy and border security was to address exactly this issue. The Administration needs many tens of billions of extra spending to ramp up the immigration courts and lawyers (and evidence-gathering folks) to move that many people through the system that quickly, and they just don't have it. If they had taken up that smaller package at the beginning of Congress, they certainly could have had it passed by now. The Democrats got their first reconciliation package (the American Rescue Plan) to Biden's desk in early March of 2021. By pursuing the One Big Beautiful Bill strategy, though, the Administration isn't going to get that funding until some time in the summer, so they won't be able to even start the ramp of resources until then.
