They'll never testify. There won't be any questions about what ICE or Border Patrol did.

As their statements are a matter of public record, they do NOT have to testify. BUT, they can NOT REFUTE THEIR PUBLIC STATEMENTS. And the courts CAN make decisions based on the public statements because they are NOT REFUTABLE. Bovino and Noem are caught in the trap they created for themselves.
