Various news outlets are reporting on a sexual harassment lawsuit filed in New Jersey on November 30 that involves a woman who hired on to work as a server at Trump's golf club in Bedminster, NJ in 2021 and her immediate supervisor. But there's a twist....
Per the woman's civil suit, the then-21 year old woman hired on in 2021 and was immediately subjected to ongoing sexual harassment by her supervisor. The harrassment went on for several months until summer 2021 when she finally told the boss NO at which point the boss materially altered her assignments and encouraged coworkers to steal her tips. Another co-worker heard of her plight and wrote a letter to Trump's "personal staff" outlining concerns about sexual abuse without naming the plaintiff. Nonetheless, the plaintiff was subsequently contacted by HR. (How would they know it was her unless they already knew of the behavior or allegations?) At that point she hired a lawyer.
And at that point, this gets vastly more problematic.
After working with her outside lawyer, the plaintiff -- still working at the club -- was approached by Alina Habba, who she already knew as a regular member at the club, but NOT as someone doing legal work representing Trump or his business. Again as alleged by the plaintiff, Habba mentioned she heard about complaints and buddied up to her and appeared to give her sisterly moral support and helpful insider legal advice. Only Habba convinced the server to drop her outside lawyer and let Habba help. And help Habba did. The only question is WHO?
Habba mentioned that events in the server's past might come up and result in a vastly reduced settlement so instead, Habba could help get an NDA deal and settlement in place. Within days, Habba had her sign a deal that prevented her from discussing details with anyone including the existence of the NDA itself (sounds familiar). The agreement Habba drafted failed to comply with NJ law regarding disclosure of terms in sexual harrassment settleent agreements.
The plaintiff signed the deal "negotiated" by Habba and only weeks later found out Habba was employed by Trump. The suit is attempting to toss out the prior deal as being in violation of New Jersey law and re-address damages associated with the original conduct. Of course, Habba may have other problems if her conduct is addressed by the state bar:
* interfering with an existing client-attorney relationship
* fraud (failing to disclose her relationship with Trump Inc. and Trump the individual)
* discouraging her "client" from having another lawyer review the terms
There really is no bottom to the ethical cesspool of Trumpworld.
