The actual report is here. It paints a bad picture of Biden's mental acuity:

However, for the reasons summarized below, we conclude that the evidence
does not establish Mr. Biden's guilt beyond a reasonable doubt. Prosecution of Mr.
Biden is also unwarranted based on our consideration of the aggravating and
mitigating factors set forth in the Department of Justice's Principles of Federal
Prosecution. For these reasons, we decline prosecution of Mr. Biden.


As the evidence always does...when you're a democrat.

Also, during his eight years as vice president, Mr. Eiden regularly wrote notes
by hand in notebooks. Some of these notes related to classified subjects, including the
President's Daily Brief and National Security Council meetings, and some of the
notes are themselves classified. After the vice presidency, Mr. Eiden kept these

classified notebooks in unsecured and unauthorized spaces at his Virginia and
Delaware homes and used some of the notebooks as reference material for his second
memoir, Promise Me, Dad, which was published in 2017. To our knowledge, no one
has identified any classified information published in Promise Me, Dad, but Mr.
Biden shared information, including some classified information, from those
notebooks with his ghostwriter. FBI agents recovered the notebooks from the office
and basement den in Mr. Biden's Delaware home in January 2023.


It's a crime to share classified information with outside parties, but whatever.

And here's the meat of it:

We have also considered that, at trial, Mr. Eiden would likely present himself
to a jury, as he did during our interview of him, as a sympathetic, well-meaning,
elderly man with a poor memory. Based on our direct interactions with and
observations of him, he is someone for whom many jurors will want to identify
reasonable doubt. It would be difficult to convince a jury that they should convict
him-by then a former president well into his eighties-of a serious felony that
requires a mental state of willfulness.


In other words, Grandpa forgot that he left the keys to the nuclear bomber on the porch again because Grandpa forgets stuff.

At this point, being prosecuted by this version of the DOJ must be some kind of badge of honor.

There is evidence that, after his vice presidency, Mr. Biden willfully retained
marked classified documents about Afghanistan and unmarked classified
handwritten notes in his notebooks, both of which he stored in unsecured places in
his home. He had no legal authority to do so, and his retention of these materials,
and disclosure of classified information from his notebooks to his ghostwriter, risked
serious damage to America's national security.


A Republican or someone other than a prominent democrat would have this at the top of the charging memo, and would be enough to secure a conviction, mens rea aside.

The programming for talking points hasn't been issued yet. I don't blame them; they have quite the pickle here.

On the one hand, Biden is tOtALLy iNnOcEnT yOu GuYs but Trump is totally guilty.
But if Biden is innocent, then he's also too senile to be President.
And if Trump is senile - as is posted here a lot - then he can't be guilty.

Quite the logical trap. Won't stop the usuals for claiming that Biden is innocent but not senile and that Trump is guilty but is senile.

It is quite another to use the more sweeping and highly prejudicial language employed later in the report. This language is not supported by the facts, nor is it appropriately used by a federal prosecutor in this context.

We request that you revisit your descriptions of President Biden's memory and revise them so that they are stated in a manner that is within the bounds of your expertise and remit.

Biden should channel in and speak with Justice Ruth Bader Ginsburg. I’m sure
she will have good advice for old Joe. Lucky Joe, he can speak with dead people.

What then, folks, is your take on the 30 times Trump told prosecutors that he had no memory of what they were asking about, events which were considerably more recent than the Biden time window?

“I do not remember.”

“I do not recall.”

“I have no recollection.”

“I have no independent recollection.”

“I have no current recollection.”

He did not remember learning about a Trump Tower meeting held in June 2016 by his son, son-in-law and campaign chairman with visiting Russians promising “dirt” on Hillary Clinton from the Russian government. He did not remember being told in advance of Russian hacking of Democratic emails before the stolen messages were posted online.

He did not remember any particular conversations with Roger J. Stone Jr., a longtime adviser, during the last months of the campaign, much less discussions with him about WikiLeaks. He did not remember discussing a possible trip to Russia to promote a proposed tower project in Moscow. He did not remember an invitation from Russia’s deputy prime minister to attend an economic forum in St. Petersburg.

As you know, the special counsel released its findings today...I was pleased to see he reached a firm conclusion that no charges should be brought about me in this case. This was an exhaustive investigation, going back more than 40 years...

I've seen headlines...about my willful retention of classified documents.... They're just plain wrong.

There is, in fact, a shortage of evidence that I willfully retained documents related to Afghanistan.


Except that you did, Joe, as the report clearly states.

There's even reference that I don't remember when my son died. How the hell dare he raise that? Frankly, when I was asked the question, I thought to myself, it isn't any of their damn business."

There's your President more or less admitting that he lied to the Special Counsel.

It's like he's daring his party to invoke the 25th Amendment and can his ass.

I bet OldJoe’s decline started with Trump Derangement Syndrome

Urban Dictionary offers up this handy definition: “Trump Derangement Syndrome (TDS) is a mental condition in which a person has been driven effectively insane due to their dislike of Donald Trump, to the point at which they will abandon all logic and reason.”

Justin Raimondo, the editorial director of Antiwar.com, wrote a piece in the Los Angeles Times in 2016 that broke TDS down into three distinct phases or stages:

1.“In the first stage of the disease, victims lose all sense of proportion. The president-elect’s every tweet provokes a firestorm, as if 140 characters were all it took to change the world.”

2.“The mid-level stages of TDS have a profound effect on the victim’s vocabulary: Sufferers speak a distinctive language consisting solely of hyperbole.”

3.“As TDS progresses, the afflicted lose the ability to distinguish fantasy from reality.”

Sounds about right in the case of OldJoe.

Yeah, fun fact — Donald Trump said he either couldn’t remember, couldn’t recall or couldn’t recollect 36 times
when answering questions about events during his campaign in written responses to Special Counsel Robert Mueller.

In the Trump U. Lawsuit Deposition, he said he didn’t remember 35 times.

In the E. Jean Carroll case he confused Carroll with his ex-wife Marla Maples and couldn’t even remember if he had an affair with her or not.

He also thinks he ran against Obama, that Jeb Bush got us into the war in Iraq, that Nikki Haley was in charge of security on January 6th,
and that Joe Biden has us on the verge of WW2!

So…

Here, exactly:

Trump’s team requested a new trial in the E. Jean Carroll case, arguing that the $5 million in damages he was ordered to pay Carroll was excessive because he was only charged with sexual abuse, that the jury had not found that Trump “raped” Carroll. The judge said, nope, not gonna' happen, because that semantic argument was wrong, that when someone sticks his finger, thumb, or any object into a woman's vagina against her will, that's rape.

But Judge Lewis Kaplan called Trump’s semantic argument “entirely unpersuasive.” He clarified that the jury found that the former president did indeed “rape” Carroll based on the common definition of the word.

Kaplan noted that New York penal law (the jury in the Carroll case was based in New York) has a “far narrower” definition of the word “rape” than in “common modern parlance, its definition in some dictionaries, in some federal and state criminal statutes, and elsewhere.”


So, yeah, a United States District Judge formally held, in a lengthy written opinion, that it is perfectly appropriate, and, indeed, entirely accurate, to call Donald Trump a rapist.
