Their immigration bill would have raised the standard to get asylum, sent away those who don't qualify and expedited cases for those who do -- and it was endorsed by the border patrol union and the Chamber of Commerce -- but convicted felon Donald Trump killed the bill because he felt it was more important to run on the border crisis than to solve the problem for the American people.
As president Biden clearly said when he announced this EO, "I've come here today to do what the Republicans in congress refuse to do, take the necessary steps to secure our border... Four months ago, we came to a deal but Republicans walked away because Trump told them to."

The statute you cited is rather vague. And it doesn't mention asylum-seekers, which is covered by the Geneva Convention. So he would have to demonstrate a "detriment", first, and then show that we can ignore the GC as a result. More specifically, he would have to convince a court when this gets challenged.

From what I've read, about 40% are granted asylum. So, yes, 60% is a majority. But 40% is a lot of people fleeing genuine life-threatening situations. It would be callous in the extreme to ignore that. Plus it would violate our obligations under the GC.
It's likely more, but without counsel it is a good bet that many with legit claims lose in court.

It appears to be an issue with border patrol scheduling the hearings. I couldn't find a lot about this quickly.
