In convicted felon Donald Trump's favor, he doesn’t have prior convictions and the charges are a low-level nonviolent felony.
But also working against the defendent's case is the fact that he has previously been involved with:
* a civil lawsuit by the State of New York for persistant fraud in his education racket branded as Trump University ($40 million lawsuit, settled in 2016 for $25 million),
* a civil lawsuit filed by the State of New York for spending funds from his supposedly charitable trust The Trump Foundation on sports paraphenalia that benefitted his political organization (settled in 2019 by fining him $2 million, forcing him to cease operation of Trump Foundation, and requiring him to communicate any financial activities to the SONY for any future charities he claimed to create),
* a civil lawsuit filed by the State of New York for years of massive fraud within the Trump Organization itself involving accounting fraud and state and federal tax fraud
Trump absoltely should not be viewed by the State of New York as a typical "first time offender" even if technically true from a criminal standpoint. It would be hard to identify any other single New York State resident who has consumed and squandered more of the people's resources in the law enforcement community and civil / criminal courts than Donald Trump over the past 15 years.
