in the Abrego Garcia case.

4th Circuit denied the Trump administration's appeal to them and delivered a well-written opinion - by the most conservative judge on the panel.

I'm sure better people here can find a link to the opinion. For now, here's a video that's mainly just a reading of the opinion. The whole opinion is on screen, so feel free to skip straight to it for your reading.

Here's a couple of snippets from the Court's opinion:

While we fully respect the Executive's robust assertion of its Article II powers, we shall not micromanage the efforts of a fine district judge attempting to implement the Supreme Court's recent decision.

The government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order. Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done.

This should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear.

The government asserts that Abrego Garcia is a terrorist and a member of MS-13. Perhaps, but perhaps not. Regardless, he is still entitled to due process. ... Moreover, the government has conceded that Abrego Garcia was wrongly or "mistakenly" deported. Why then should it not make what was wrong, right?

2. He's had 3 cracks up in front of judges.

Yep. They're all irrelevant.

He had 3 cracks in front of judges. But there should have been a 4th. He didn't get that and instead got illegally disappeared to another country.

Jump up and down all you want. That is the important fact and the one the 4th Circuit judges honed in on. Even they said it doesn't matter if he's a member of MS-13 or not. It's right in the opinion for you to read. Not my opinion - the unanimous opinion of 3 appellate court judges.

I found this article about Mr. Garcia. Some may not like it because it appears to be impartial, or as Joe Friday would say, “Just the facts, ma’am.”

Regardless of whether you think he as innocent as a newborn lamb or guilty as sin (or something in between), when in America, he had the right to due process (regardless of how you spell it) before deportation.

God damn Constitution. What idiots ever thought that would be a good idea? Other than some guys like Washington, Jefferson, Adams, Franklin, Hamilton, etc., etc.

Here are the only relevant court orders:

SUPREME COURT: The order properly requires the Government to “facilitate” Abrego Garcia’s release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador.

THE 4th CIRCUIT COURT OF APPEALS: The administration is “asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order. Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done. This should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear.”

As to the “evidence” that Abrego Garcia is a gang member, here's Roger Parloff, Yale Law School graduate and senior editor at Lawfare: “It's double hearsay stemming from a document written by somebody indicted for misconduct.”

Not me. I'm just repeating (and lightly paraphrasing) the opinion of the 4th Circuit Court judges. I already quoted them above if you don't believe me. They are the ones that say the MS-13 stuff is a red herring. Member or not, he needs due process before he can be deported.

You should stop there and recognize that your NO DEW PWOCESS argument is kaput, right there.

Once again, it's not my due process argument. It is Mr. Garcia's due process argument. And the 4th circuit agrees that his right to due process before the actual deportation was violated.

This is pretty simple stuff. That you can't understand this speaks volumes to your willful blindness to the atrocities the Trump administration is committing against people living (now formerly living) in the United States of America.

Spankee and his ignorant morots ignored a federal ruling--which they acknowledged was "their error". THAT is what caused the current situation--nothing else.
