SCOTUS is going to hear arguments. Kinda surprised, given that the language is very clear on the subject. Only in cases of invading (presumably armed) forces (of a sovereign nation) is that right not granted, and migrants aren't invading forces.

SCOTUS is going to hear arguments. Kinda surprised, given that the language is very clear on the subject.

They won't be getting into the actual merits of the 14th Amendment. This is going up on the procedural question of whether district courts have the ability to issue nationwide injunctions. You can read the arguments in their emergency appeal here:
