Judge Xinis, who is overseeing the illegal deportation case of Abrego-Garcia, is working overtime and demanding that the parties do the same.

The USSC confirmed her initial order for the US Government to return Abrego-Garcia to the US, and confirmed her authority in the case. So she did just that.

Just a couple of hours after the USSC handed down their decision, she ordered a status report (where is he, what have you done to get him back, what else are you going to do to get him back) by 9 am yesterday. The Trump admin whined and complained and didn't comply. She again ordered the report by 11 am. More whining. So she ordered the parties to appear in court at 1 pm. The poor lawyer for the government (the sucker who replaced the previous lawyer whom the Trump admin fired for actually telling the truth) couldn't answer the questions and hinted that his client isn't giving him the answers.

Judge Xinis wasn't happy. So now the admin needs to file a daily report by 5 pm every day - including weekends, so today and tomorrow. And she also basically invited the attorneys representing Abrego-Garcia to ask for a contempt finding.

This one is getting more interesting every day. I'm sure the motion for contempt is forthcoming today, and I hope it includes subpoenas for some actual officials to appear in court and testify as to those questions. If they're not going to tell their lawyer, she'll drag their butts into court and ask them directly. And I really hope she's ready to toss some folks in jail until they comply. Let's hold some feet to the fire and get answers.

This is all from reporting by Michael Popok here:

All well and good, but what power do courts have to actually enforce anything? Precious little, I think.

But I have to ask the obvious: if the gov't admitted they made a mistake in deporting Abrego-Garcia, why the hell don't they just bring him back? All the talk of being unable to since he's now outside the jurisdiction of the U.S. is utter BS. All it would take is one call from Trump or Rubio to Salvadoran President Nayib Bukele to return him on the next flight or else the 6 million they are giving him would be revoked. Why the hell don't just they end this lunacy and get him back?

About the only power I know of is putting people in jail for contempt until they comply.

That is the question the judge is trying to get to.

My guess is that it is an authoritarian power play. They want to do whatever the heck they want with no oversight and no questions.

Especially when the DOJ is bought and paid for and weaponized to do Trump's bidding in all things.

why the hell don't they just bring him back?

He might have a horror story to tell that they would rather people don't hear.

Well, first, SCOTUS issued a vague guideline and remanded to the lower court to interpret it. “The District Court should clarify its directive, with due regard for the deference owed to the Executive Branch in the conduct of foreign affairs.” This has allowed the government to hem and haw.

Second, the Trump DOJ doesn't want to admit they have the ability to return these people. They want the absolute power to deport anyone.

Third, if the Trump DOJ brought Abrego-Garcia back, the media would never stop interviewing him about conditions in the El Salvadoran hellhole which, for most Americans, would be attitude-changing.

Finally, there's a very slight possibility he's dead.

Bingo. Authoritarian playbook all the way. Deport or disappear anyone they want.

Finally, there's a very slight possibility he's dead.

I fear that it's significantly more than slight. If so, I'm sure they don't want to admit that to anyone.

And we have it. Agrego-Garcia's counsel has filed the motion for contempt.

Well, per an update from Joyce Vance, and based on a court filing by the Trump admin today:

3. It is my understanding based on official reporting from our Embassy in San
Salvador that Abrego Garcia is currently being held in the Terrorism Confinement Center in El
Salvador. He is alive and secure in that facility. He is detained pursuant to the sovereign, domestic
authority of El Salvador.
I declare under penalty of perjury that the foregoing is true and correct.
Executed this 12th day of April 2025.
