Here's one of the many clarifying passages in the White House (notionally GSA) letter. It demands Harvard set up a system of political commissars who will enforce hiring and admissions set asides for MAGA luminaries and high school red hats.
• Viewpoint Diversity in Admissions and Hiring.
By August 2025, the University shall commission an external party, which shall satisfy the federal government as to its competence and good faith, to audit the student body, faculty, staff, and leadership for viewpoint diversity, such that each department, field, or teaching unit must be individually viewpoint diverse. This audit shall begin no later than the summer of 2025 and shall proceed on a department-by-department, field-by-field, or teaching-unit-by-teaching-unit basis as appropriate. The report of the external party shall be submitted to University leadership and
the federal government no later than the end of 2025. Harvard must abolish all criteria, preferences, and practices, whether mandatory or optional, throughout its admissions and hiring practices, that function as ideological litmus tests. Every department or field found to lack viewpoint diversity must be reformed by hiring a critical mass of new faculty within that department or field who will provide viewpoint diversity; every teaching unit found to lack viewpoint diversity must be reformed by admitting a critical mass of students who will provide viewpoint diversity. If the review finds that the existing faculty in the relevant department or field are not capable of hiring for viewpoint diversity, or that the relevant teaching unit is not capable of admitting a critical mass of students with diverse viewpoints, hiring or admissions within that department, field, or teaching unit shall be transferred to the closest cognate department, field, or teaching unit that is capable of achieving viewpoint diversity. This audit shall be performed and the same steps taken to establish viewpoint diversity every year during the period in which reforms are being implemented, which shall be at least until the end of 2028. I think viewpoint diversity should be extended to all religious schools and universities. Not just selective blue Ivy League Universities.

Where else did this happen? The Nazi government’s project of remaking German universities was broadly successful, but it produced unintended consequences. The quality of education suffered significantly as classes were regularly cancelled for political assemblies and students' schedules became filled with ideological and paramilitary training.

Yes, they do. Or rather, they have a right for the same opportunity to apply for federal research money free of unconstitutional conditions. The government can't require you to abandon a constitutional protection or right as a condition for obtaining a federal benefit, even a discretionary one.
So, for example, the State of Florida can't require that anyone who wants to have a driver's license has to issue a written endorsement of Donald Trump for President. Getting a driver's license is a discretionary benefit - you don't have a right to get a driver's license. But they can't violate your First Amendment rights as a condition of letting you get it.
If there's an actual statute (like Title IX) that governs the University, then they have to comply with that law. But I'm pretty sure that many of the demands made by the Administration (like having more conservative voices) don't fall within Title IX.

Which is why that wouldn't be Harvard's argument. I expect they'll argue that they have taken sufficient steps to comply with whatever the law requires to ensure Jewish students access to campus facilities. Since the demands levied by the Administration go well beyond merely addressing Jewish student concerns on campus, that's where they probably feel pretty good about their case in court.
