Allowing Jewish students the same access to campus facilities as Hamas supporters is unConstitutional? That'll be fun for Harvard to argue in court.

Which is why that wouldn't be Harvard's argument. I expect they'll argue that they have taken sufficient steps to comply with whatever the law requires to ensure Jewish students access to campus facilities. Since the demands levied by the Administration go well beyond merely addressing Jewish student concerns on campus, that's where they probably feel pretty good about their case in court.
