Whiskey Pete has backed down from previous threats to court-martial retired Navy captain senator Mark Kelly for his role in a video telling service members they "can refuse illegal orders." Instead, Hegseth issued a formal censure to Kelly, the defense secretary announced on X today because of course, and has initiated proceedings aiming to demote Kelly in retirement.
But demoting Kelly requires an administrative process known as officer grade determination, which by law makes its decisions based on an officer's conduct while on active duty. It's not clear how the Navy can legally consider Kelly's post-retirement conduct when making its determination.Next, maybe Hegseth will move to strip Kelly of his trips to space.

No, other than making noises at Kelly, Kegsbreath has not censured him. Nor is there any formal way for Kegsbreath to pursue his political vendetta by docking Kelly’s retirement pay; the offense of reminding active duty personnel not to follow unlawful orders did not occur while Kelly was in active service.
But as Kelly knows well- the law has never been a guardrail observed by this administration in its pursuit of naked vengeance.

Kelly is no longer in the active military, subject to the US Code of Military Justice.
IF he is brought back to active status for the purpose of prosecution for some “crime”, it must be for a crime or infraction committed while serving in the active military.
What crime did Mark Kelly commit while serving on active duty? The answer is “none”, though I am sure that Mssr. Kegsbreath, as has Mme. Blondi in numerous instances, will drum up some fictitious accusation to keep this kerfuffle roiling on social media, but utterly failing when it comes to the matter of actual evidence and the law.
