" Berkshire Hathaway's (BRK.A) (BRK.B) PacifiCorp utility agreed to pay $575M to resolve U.S. government claims for damages resulting from six wildfires in Oregon and California that burned nearly 290K acres of federal land, the U.S. Department of Justice said Friday.

The settlement resolves the government's claims that PacifiCorp's electrical lines negligently started all six fires and will help repay the substantial costs incurred in fighting the fires, the DoJ said.

Five of the fires - Archie Creek, Echo Mountain Complex, Slater, South Obenchain, and 242 - began in September 2020 and burned ~250K acres of federal land, and the sixth fire, McKinney, began in July 2022 and burned 39K acres of federal land.

The claims resolved by the settlement are allegations only, and there has been no determination of liability; the company denied liability in agreeing to the settlement.

Earlier this week, PacifiCorp said it agreed to sell many of its assets in Washington state to Portland General Electric for $1.9B, citing the need to boost liquidity as it defends against wildfire litigation."

Sometimes you sell your sports car when the repairs become too expensive to justify keeping it, and you can make better use of the money elsewhere in your family budget. It be true that your family has grown in size and diapers are expensive. One of those reasons (expensive maintenance vs. need for diapers) is more palatable to the buyer than the other. And thus we end up with "the need to boost liquidity".

Berkshire sitting with $300 Billion in cash could easily move more money into PacifiCorp - if it made financial sense. But it's a murky place to operate now.

No doubt the asset sale was contingent on the settlement, Greg gets an A to start his journey. Friday we may get a hint with respect to who is in control. Does Greg agree with Buffett that under his new leadership brkb is more valuable hence buybacks have resumed? Stay tuned. Btw, the new VL comes out tomorrow I think. If anyone wants it privately let me know, it’s hard to share it here.

I think that was one of the settlements with more to come, about 10% remain for $50+B maximum claims to go. Doubtful that they will have to pay out the full $50B.

$2.2B have been paid out.

5,000 class members have trials set for 2026-2028 to assess damage and emotional distress compensation. Some think it could be as much as $5-8B if things go really badly.
