Uhhh...no.

The Constitution does not address immigration. Well, not directly. It says Congress is tasked with controlling it. Article 1, section 8, clause 4. It does NOT specify any crime.

As albaby has explained, what is happening now is consistent with federal law. So if Texas does not have a law regarding the crossing of an international border, then they do not have the right or authority to imprison border crossers.
