I dunno. He issued the order to "kill them all". My understanding is "kill them all" was an oral order. I'm into an area where I need an expert in the areas opinion, but I think if there's evidence an oral order was given to kill them all, that would stand up. "Destroy it" is the order to give, not "kill them all".
