Back in 2021 Joe Biden moved to fire Sean Spicer from a Naval Academy board. He did this for no other reason than to be spiteful. Well, Spicer sued and ultimately lost.

...but there's a silver lining:

President-elect Donald Trump is arriving at the White House armed with a legal weapon that will let him fire any of President Joe Biden’s appointees.

Thanks in part to a court fight former Trump White House spokesman Sean Spicer lost over his firing by Biden from a three-year term to the Board of Visitors to the United States Naval Academy, the incoming president will have the legal backing to dump any of Biden’s over 4,000 appointments who try to stick around.

And the best part, Spicer told Secrets, “They’ll have no one to blame but Biden himself.”

“What no one ever understood was this was not about actually getting back on the board, because my term had been expired for months. It was forcing them to argue in the affirmative that they had the ultimate authority to fire anybody at any time, which they did. And the court accepted that. So the Biden administration is now on record in court, and the court agreed that the president had absolute authority to fire anyone he wants,” Spicer said in an interview.

“The whole point is now, on day one, President Trump can go in and fire everyone and say it was the Biden folks who told us that we could do this,” he said of aiding White House executives who seek to hire the loyal team that Trump wants.

No it's not. There's never been any realistic dispute that the President can fire anyone that he's appointed, absent an express provision otherwise.

Here's the order dismissing Spicer's claims. The court never took seriously Spicer's suggestion that an appointed official could not be summarily fired by the President, and cited longstanding and uniform Supreme Court precedent on the issue. They dismissed his substantive argument in three pages, mostly just filled with all the courts that have already addressed this issue - including a SCOTUS decision from just the prior year.

That isn't "playing chess" - it's getting your butt kicked in court because you've raised arguments that have been rejected for decades.

The circuit courts (which are above the district court that issued this ruling) issued an opinion squarely on point just three years prior.

This ruling means nothing. None of the Biden officials would have been filing suits on January 21st, because there is no real legal argument against the new President haivng the power to fire the appointees from the prior President. That's why of the 4,000 or so appointees under the Trump administration, only Spicer bothered to file this pointless suit. And why it took the federal court less than three months to throw him out of court.

This is just a district court order quickly throwing out a suit because the law on point was crystal clear. It accomplished nothing, and holds no precedential value.
