...for not hiring refugees and asylum seekers. Oh, the horror!

The Justice Department filed a lawsuit today against Space Exploration Technologies Corporation (SpaceX) for discriminating against asylees and refugees in hiring. The lawsuit alleges that, from at least September 2018 to May 2022, SpaceX routinely discouraged asylees and refugees from applying and refused to hire or consider them, because of their citizenship status, in violation of the Immigration and Nationality Act (INA).

Nonsense on stilts, and this is why us on the right correctly point toward a weaponized Justice Department.

The United States seeks fair consideration and back pay for asylees and refugees who were deterred or denied employment at SpaceX due to the alleged discrimination. The United States also seeks civil penalties in an amount to be determined by the court and policy changes to ensure it complies with the INA's nondiscrimination mandate going forward.

How do you give someone back pay for a job they never had?

Anyone who's worked in or near this field knows that rocket and satellite technology (SpaceX handles both) falls under ITAR. What's ITAR, you might ask?

Authority and delegation. Section 38 of the Arms Export Control Act (22 U.S.C. 2778), as amended, authorizes the President to control the export and import of defense articles and defense services. The statutory authority of the President to promulgate regulations with respect to exports of defense articles and defense services is delegated to the Secretary of State by Executive Order 13637. This subchapter implements that authority, as well as other relevant authorities in the Arms Export Control Act (22 U.S.C. 2751 et seq.). The Secretary of State delegates the authority to administer the regulations in this subchapter to the Deputy Assistant Secretary of State for Defense Trade Controls, Bureau of Political-Military Affairs.

You can't risk foreign exposure of certain articles that are on the United States Munitions list.

(What follows after that is pretty much any part you hang on a rocket)

So Merrick Garland/Brandon is effectively suing SpaceX for following US regulations on the handling of sensitive technology. And no, don't give me any BS about how 'they could have found them another job'. That dog don't hunt.

If I wanted to weaken America, I'd root for stuff like this to go forward. They're only suing SpaceX because of Elon as most other defense contractors have this same policy.

Perhaps you didn't realize that this case was started by the Trump administration in 2020.

From the indictment:

10. On June 8, 2020, IER notified SpaceX that IER had initiated an investigation into whether SpaceX was engaging in any pattern or practice of discrimination in violation of 8 U.S.C. §§ 1324b(a)(l) or (a)(6) and requested information and documents related to its investigation.

11. On August 13, 2020, IER reiterated to SpaceX that it had initiated an investigation into whether SpaceX was engaging in a pattern or practice of discrimination based on citizenship or immigration status, in violation of 8 U.S.C. §§ 1324b(a)(l) or (a)(6).

So to be clear, you're complaining that the Trump administration was weaponizing the Justice Department, right?
