It appears that both BHE & BNSF are becoming big targets for plaintiff lawsuits. Nothing like a rich corporation for the salivating ambulance chasers. Buffett discussed this problem with BHE in the 2023 annual report but it now appears that BNSF is also becoming a similar problem for Berkshire. Clearly they are not as good businesses as they were thought to be by Buffett & Abel.

The agreement that was violated dates from 1991.
But the violation itself dates from a period long after Berkshire acquired BNSF, starting in 2012. Bakken shale oil was not a thing in 1991.
The railway's side of the story probably ties into a stipulation in the agreement that the tribe not “arbitrarily withhold permission” if there should be a future BNSF request to increase the number of trains or cars. I guess that either BNSF didn't ask permission, or the denial of BNSF's request was not deemed to have been arbitrary.

The Swinomish Tribe filed the lawsuit in 2015. BNSF had already stipulated it was trespassing. The only thing to be decided was the amount of the damages. The judge concluded the damages were equal to the amount of profit BNSF made by trespassing.

and\or the integrity of BH is overhyped; they are not shy of taking credit when there is good news.
this cannot be absolved by hiding behind 'letting the CEOs run the operations and just sending BH the cash for allocation'.
