Is this thing actually being built? I hear sounds of construction in the background. My understanding was that only the underground portion was allowed to go ahead at this point, with the above ground eye-sore still on hold pending further litigation.

That original order has been stayed. Right now, the procedural posture is that the lower court issued the injunction you describe above. The appellate court issued a limited stay of that order until such time as they hear the government's request for a permanent stay (ie. a stay of the order until the appeal is resolved), which hearings are scheduled for early June.
