Pretty sure an EO doesn't overrule a court ruling. It basically says that with "fullest extent permissible". It's not permissible to prosecute, per previous rulings.

Read the full EO. They intend to use any law or city ordinance they can find, like starting a fire without a permit, to prosecute anyone who "desecrates" the flag.
