Alex Pretti, who was killed by ICE agents, was putting himself between ICE agents and a woman, trying to protect her from them. He put his hand up, backed away, and had no handgun in his hand, only his phone, and ICE agents repeatedly sprayed Pretti in the face with a chemical agent, tackled him, and disarmed him.

You can see the agent in the gray coat run away with Pretti's gun before the first shots are fired. Pretti was unarmed when he was shot.
