No. The judge presumed the evidence had already been destroyed or was no longer admissible as evidence in court (for various reasons). Thus, the attorneys representing Alex Pretti's family can factually state the evidence was destroyed by the govt and THAT can be held against the govt at trial. $$$$$$$$.
