A judge in Maryland ordered temporary reinstatement of thousands of employees, finding that some agencies acted unlawfully in mass firing probationary employees without proper notice. The Department of Agriculture was required to reinstate nearly 6,000 probationary employees. Same at other agencies.

Earlier this month, a federal district court ruled that the Office of Personnel Management (OPM) acted unlawfully when it directed federal agencies to terminate more than 25,000 probationary employees at the start of 2025.

The decision, issued by Judge William Alsup of the Northern District of California, September 12, 2025, concluded that the OPM exceeded its statutory authority by ordering removals and requiring agencies to use pre-drafted termination letters citing performance as the reason, even though performance was not the true basis for the separations.



The Shadow Docket Supreme Court allowed certain probationary terminations to go forward, not because it decided the firings were lawful, but due to standing or procedural issues.
