I suppose I can add some commentary.
Is this a political speech rather than a studious commentary on Supreme Court jurisprudence? Of course it is. Biden isn't a fool.
But he's not entirely wrong, either. We all realize that because he knows there is some form of immunity, Trump will test that immunity early and often. His MO is to do first and battle it out in the courts later. If he's not in court, he's not pushing the envelope hard enough. He doesn't try to stay on the right side of the law, he wants to see how far across the line he can get. And he's more than willing to rack up legal fees doing so - the fees are just a cost of doing business. With the legal fees paid by the people of the US defending the President in court, there's even less incentive to try to keep from crossing the line.
Biden had it right in his speech the morning after the debate. Trump is a one man crime spree. He's been mostly getting away with it by wearing down his opponents in court. And he will continue to do that in a second term as president. He will wear us all out in court if we give him the opportunity. This decision by the USSC serves only to enable that behavior.
