LegalEagle weighs-in. Pretty much what albaby has been posting, but he also includes a nice timeline of events. One thing I note is that while this board likes to compare to HRC, it might be more instructive to compare to Pence. Pence also had documents he shouldn't have, and Pence also is a Republican. Pence isn't being charged because he complied with the government's request for return of the documents. Trump is being charged because he didn't, and actively tried to avoid handing them over. Also, Trump isn't be charged for possession of documents that he did return prior to the subpoena. Only the stuff he tried to hide.
