Is not physical restraint assault?

Almost always that is an assault, but it's the type of assault that most jurisdictions differentiate: there is often a "simple" assault that may include a relatively minor touching (possibly including confinement without injury or low injury) and an "aggravated" assault type that includes things like breaking bones, lacerations that require stitching, oftentimes using the threat of a gun regardless of injury may be included. It varies somewhat from state to state and 'violent' crime may be used to indicate that type of distinction.
