Fundamentally, the definition of mental incompetence is the ability to determine "right" from "wrong". If someone commits a crime, that is prima facie evidence they cannot make that distinction, so they are funny in the head.
fwiw, I have a neighbor who says all people convicted of a crime should be executed. He cites the recidivism rate for his position.
