Insiders have cast doubt on whether a journalist who was hired as an expert witness by the legal team of a gang rapist sought the proper permissions from the BBC.

Mary Harper, a BBC Africa reporter, argued against Yaqub Ahmed, 34, being returned to Somalia. Ahmed, 34, was sent back to Somalia in August after a lengthy legal battle that was reported to have cost up to £1 million.

A source highlighted the BBC’s strict guidelines and processes that govern external engagements for staff.
“Had a request been submitted then there would have been a conversation with her manager about the case,” they said. “People are very aware of their responsibilities. There are concerns that it wasn’t flagged by the individual.”

A number of journalists expressed surprise at the situation and were unaware of any other instances in which staffers have provided legal evidence in court cases.

“She would have needed to get permission from management, even if it was unpaid,” one journalist said. “It’s so strange because we are policed with quite intrusive questions.”

They noted the thoroughness of the approvals system introduced by the BBC in January 2021 in a bid to provide great transparency around the engagements undertaken by staff.

Another added that it reflected terribly on the broadcaster. “Why was she asked? What is her connection to him?” they said.
Judges in the case dismissed many of Harper’s claims and raised concerns about her objectivity, according to The Mail on Sunday.
“It was concerning to hear that she had not read thoroughly key material concerning the appellant’s case,” they said. >b>“The failure to do so and the failure to make reference to previous contrary findings by the tribunal when providing her opinion about risk caused us to have concerns about the objectivity of her evidence on this issue.”
