The government can't bring charges against someone for anti-semitic displays of hate.
The key term in "hate crimes" is "crimes." Hate crime statutes are invariably drafted as covering crimes where hate is a factor, not merely criminalizing hate. So (for example) if the protestors had beaten up the owners of the restaurant because they were Jewish, they could have been charged with a hate crime.
But it's perfectly legal - though horrible - for you to just stand in the street and shout anti-semitic things at a restaurant, as long as you don't commit any underlying crimes while doing it. They can't charge you for it. They can't even impose civil liability for it:
