Dementia Don's been sad posting, crying that "JUDGE MERCHAN WILL NOT, FOR WHATEVER REASON, LET ME USE THAT AS A DEFENSE IN THIS RIGGED TRIAL." And yes, he did refer to "advice" of counsel as "advise" of counsel at times.

But in March, his attorneys told the court "he does not intend to assert a formal advice-of-counsel defense..."

Now he could have done so but it would have required him to agree to the legal terms of such a defense, such as waiving attorney-client privilege -- making pretty much all attorney-client communications available to the prosecution -- and, likely, testifying under oath.

But everyone knows Dementia Don's a chickensh!t.
