They finally got it in front of a former Scalia clerk and George W. Bush appointee who said, "He's Black, right?" and, hey, three times was the charm.

Kidding, it was just a coincidence that the department of justice invoked a federal felony statute from the Reconstruction Era, designed to safeguard the rights of Black Americans to do things like worship and vote amid terror and violence from the Ku Klux Klan.
